Daniel Penny Breaks Silence, Says Jordan Neely Killing ‘Had Nothing to Do With Race

In an exclusive interview with The New York Post, Daniel Penny, the man accused of using a chokehold that led to the death of Jordan Neely, spoke out to refute any claims that the incident was racially motivated.

Penny did not provide specific details about the events leading up to the chokehold on the train but expressed that he would repeat his actions if faced with a similar situation. Neely, a homeless Black man with a history of mental illness, tragically died nearly three weeks ago on a northbound F train in lower Manhattan.

The interview, published over the weekend, showcased Penny’s condolences for the loss of life and his hope for systemic changes to prevent similar incidents in the future. Penny emphasized that the tragedy had nothing to do with race and stated his love and appreciation for all people and cultures, citing his past travels and planned trips to Africa.

Penny, a 24-year-old former Marine, was arrested on May 12 and charged with second-degree manslaughter. He was released on a $100,000 bond with certain restrictions, including surrendering his passports and seeking court permission for out-of-state travel.

Penny’s lawyers claim he acted in self-defense and intended to protect other subway riders from a perceived threat. They argue that his actions were not intended to cause Neely’s death and believe he will be exonerated.

Christopher Neely, Jordan’s uncle, expressed concern that Penny might repeat his actions if not held accountable by the law. He called for the prosecution, stating that Penny’s belief that his actions were justified is monstrous.

Donte Mills, another lawyer representing Neely’s family, disagreed with Penny’s account, alleging that the veteran acted with indifference and cared only about himself.

The Neely family desires the case to proceed to trial and seeks charges against the two individuals who assisted Penny during the incident.
